?A ideo uploaded on Tiktok resulted in a 23-year-old Thai national being brought to the Magistrate’s Court, 17th October. Sumaiyah Daraso was charged for committing a public nuisance by causing annoyance to the students and staff of a school which is an offence under section 268 of the Penal Code, Chapter 22 and carries a fine.

On 11th October, Sumaiyah was within the compound of the school to accompany a family friend to pick her children up from the school. As she was waiting, she recorded a ideo of students lea ing the said school. Three days later, she uploaded the ideo onto her public TikTok account paired with a background audio of her choosing and captioned it with the name of a student. The ideo exposed the faces of the students and the ehicle used. She subsequently took the ideo down from her account but as the account was public, the ideo was able to be downloaded by other TikTok users and reuploaded to arious TikTok accounts, which led to the ideo going iral on the social media platform. The mat
ter was reported to the Royal Brunei Police Force for in estigation.

Deputy Public Prosecutors Siti Khalillah Haji Hussin and Nur Ruzana Haji Adnan appeared for the Public Prosecutor. It was highlighted by the Prosecution that schools should be afforded the assurance and peace of mind that anonymity of their students would not be compromised when they carry on with their daily school acti ities. It was further submitted that the sentence imposed should send a strong message to the general public that blatant disregard for the safety and pri acy of the students and staff in a school compound will not be taken lightly.

The Defendant pleaded guilty before the Honourable Magistrate Hajah Normazdina binti Haji Md Maskub and was sentenced to a fine of one thousand dollars in default of 1 month imprisonment.
